Extended Family

We appreciate that extended members of the family play a crucial role in children's lives. This may take the form of contact but often family members have full time care of children.
We are able to advise grandparents, aunts, uncles, stepparents and other family members on your options in these circumstances.

We can advise you on:

  • Contact
We are able to assist family members, particularly grandparents, in negotiating and agreeing contact arrangements so they may play an active role in a child's life.
  • Parental Responsibility Agreements
These are agreements grant an individual legal responsibility for a child by way of agreement with a person or all persons who already hold such responsibility for a child. It allows you to make decisions regarding a child's care (for example their health care), although those decisions should be made in consultation with all others who have parental responsibility.
These agreements particularly assist step parents.
  • Residence Orders
This is an Order made by the Court which determines who a child lives with, and any person who has a residence Order automatically has parental responsibility for a child.
  • Special Guardianship
Special Guardianship is an Order made by the Court which determines who has care of the child and allows that person or people who have Special Guardianship to make decisions regarding the care of the child without consultation of any other person who may have care of a child.
  • Adoption
Adoption is made by Court Order and determines that you have become a child's parent. It extinguishes the parental status of the birth parents.

Inheritance implications for Family Members

This is a vital aspect of advice that is frequently overlooked. However, the legal consequences of each of these options has a significant impact on the laws relating to wills and inheritance generally.
